What Types of Financial Compensation May I Claim After a New York Personal Injury Accident?

If somebody else is liable for your catastrophic injuries, for example, you may be entitled to the following types of financial compensation:

Earning Potential

Financial compensation for the reduction of your earning potential because of an injury that impacts your ability to work.

Pain and Suffering

Monetary compensation for physical pain and suffering as a result of your injury.

Pain and Suffering - Future

Financial compensation for physical pain that you will suffer in the future as a result of your injury.

Emotional Distress

Monetary compensation for emotional damages, psychological pain and suffering, as a result of your injury.

Medical Expenses

Monetary compensation for expenses such as hospital bills, surgeries, medications and occupational therapy incurred as a result of your injury.

Zone of Danger - Emotional Distress

Financial compensation for emotional damages. For example, if you were in close proximity to an immediate family member, such as a grandparent, that was struck by unsecured heavy building materials and observed serious injury to them while the accident was occurring inches away from you, you may be entitled to compensation for emotional distress.

Medical Expenses - Future

Financial compensation for expenses such as hospital bills, surgeries, medications and occupational therapy that you will incur in the future, as a result of your injury.

Lost Wages

Monetary compensation for income you have lost as a result of your injury. Workers’ compensation may be paying you only about two-thirds of your average weekly wage.

Lost Wages - Future

Financial compensation for income that you won’t be able to earn in the future as a result of your injury.

Loss of Consortium

If your injury damaged your relationship with your spouse or partner, for example, your spouse or partner may be entitled to monetary compensation.

Wrongful Death

Financial compensation for damages such as lost financial support as a result of losing a family member that supported the family.

Punitive Damages

Compensation, for example, to punish and deter a defendant for conduct that was continuous, deliberate and malicious.

Out-of-pocket Expenses

Monetary compensation for reimbursement of expenses related to your injury, such as specialized transportation to medical providers or the construction of a wheelchair ramp in your home.

Permanent Disability

Financial compensation, for example, for a catastrophic injury suffered at a construction site when somebody other than your employer is liable for the accident.
